Banking Terms and Conditions of Use
By using this site, you
are indicating your acceptance of our Terms and Conditions of Use.
ACCOUNT
ELIGIBILITY
In order to activate
your Internet Banking Services, you must have at least one eligible
account with us. Eligible Accounts include the following:
- Checking Account
- Savings Account
- Certificate of
Deposit
- IRA Account
- Club Account
- Loan Account
By enrolling in
Internet Banking, you will be given access to all eligible bank accounts
of which you are an owner, unless the account you wish to access
requires two or more signatures. Accounts requiring more than one
signature are not eligible for transfers of money between accounts
through Internet Banking.
You will choose your
own User ID and Password as part of the enrollment process. You will be
asked to change your password from time to time for security reasons.
You should keep your password in a secure location. Any person having
access to your User ID and Password will be able to access Internet
Banking Services and perform all transactions, including reviewing
account information and making transfers to other accounts.
You, means the owner of
an individual account, or in the event of a joint account, those persons
identified on the joint account agreement as having authority to access
the joint account with a single signature.
In the event of a joint
application for a single User ID, eligible accounts shall only include
those accounts for which each owner has authority to access each account
with a single signature.
In the event a joint
account ceases to be a joint account, you shall promptly notify us and
apply for a new User ID. Until you notify us of this joint account
change, you continue to authorize us to process transactions using the
current User ID.
ACCESS
You can use Internet
Banking Services to access your accounts. Our Internet Banking Services
will allow you to:
- View account
balances
- Transfer money
between accounts
- Review recent
transactions
- Download account
information
- Communicate with us
via email
- Process a stop
payment
Internet Banking
Services shall be accessible 24 hours a day, seven days a week. Any
transfer between your accounts that is completed before
11:00 pm (EST) on a business day is posted to
your account on the same day. Any transfer completed after
11:00 pm (EST) on a business day or at any
time on a Saturday, Sunday or banking holiday will be posted on the next
business day. Our business days are Monday through Friday. Holidays
are not included. Without limiting any other disclosure or liability
limitation contained in this Agreement, we shall not be liable for any
damage or injury arising out of failure to provide access to your
accounts or your ability or inability to transact or engage in other
Internet Services or any errors in or failure to complete transactions
through the online site due to catastrophic system failure at Harvest
Community Bank or at an Internet provider, or due to other unforeseen
acts beyond the reasonable control of Harvest Community Bank.
Your access to Internet
Banking Services shall be determined by the sole discretion of Harvest
Community Bank. Subject to applicable law, Harvest Community Bank
reserves the right to modify, suspend, or terminate access to the
Internet Banking Service at any time.
EQUIPMENT AND
SOFTWARE REQUIREMENTS
In order to use
Internet Banking Services, you will need a computer with a modem and a
web browser. Please refer to the Security and Browser Enrollment Page
for specific hardware and software requirements. You are responsible
for the set-up and maintenance of your home computer and modem. You
agree that we are not responsible for any errors or failures from any
malfunction of your computer or any virus or other problems related to
the Internet Banking Services.
FUNDS TRANSFERS
AND ACCOUNT INFORMATION
To use Internet
Banking, you must first complete an online enrollment form. Upon
verification, you will be able to perform transfers, view balances and
transaction activity. We deduct the amount of your transfer from your
account on the date you instruct us to process it. We may refuse to act
on your funds transfer instructions if sufficient funds, including funds
available under any overdraft protection plan are not available in your
account on the date you want us to transfer funds.
CONSUMER RIGHTS
AND RESPONSIBILITIES
UNDER REGULATION E
You are responsible for
keeping your User ID and password and account data confidential.
Harvest Community Bank is entitled to act on transaction instructions
received using your password and you agree the use of your password will
have the same effect as your signature in authorizing transactions. If
you authorize other persons to use your password in any manner, your
authorization shall be considered unlimited in amount and manner until
you have notified us in writing that you have revoked the authorization
(and changed your password), and you are responsible for any
transactions made such persons and Harvest Community Bank shall not be
liable for any damages or injury arising out of or resulting from any
unauthorized use of your password, unless and until you notify us that
transactions by that person are no longer authorized ( and we have a
reasonable opportunity to act upon the change of your password).
You should notify us at
once if you believe your password has been lost or stolen or that
someone has transferred or may transfer money from your account without
your permission, or if you suspect any fraudulent activity on your
account. If you do not notify us promptly, it is possible that you
could lose all the money in your account (plus your maximum overdraft
protection). To notify us, call 1 856 769-5044, ext. 308 during normal banking
hours. Notification by electronic mail or in paper copy alone will not
constitute effective notice under this Section.
NOTE:
Federal law requires that if you believe your password has been lost or
stolen and you tell us within two business days after you learn of the
loss or theft, you can lose no more than $50 if someone used your
password without your permission.
If you
do not tell us
within two business days after you learn of the loss or theft of your
password, and we can prove that we could have stopped someone from using
your password without your permission if you had told us, you could lose
as much as $500.
Also, if your statement
shows transactions that you did not make, tell us at once. If you
do not tell us within 60 days after the first statement showing such a
transaction was mailed to you, you may not get back any money you lost
after the 60 days, if we can prove that we could have stopped someone
from taking the money if you had told us in time. Your role is
extremely important in the prevention of any wrongful use of your
account. You must promptly examine your account statement upon
receipt. If you find that your records and ours disagree, you must

We must hear from you
no later than 60 days after we sent the first statement on which the
problem or error appeared. When you contact us, our representative will
need to know the following information:
- Your name and account number
- A description of the error
or the transaction you are unsure about and the explanation of why your
believe it is an error or why you need more information; and
- The dollar amount of the
suspected error
If you tell us orally
(or by electronic communication), we may require that you send us your
complaint or question in writing within ten business days. We will tell
you the results of our investigation within ten business days after we
hear from you and will correct any error promptly. If we need more
time, however, we may take up to 45 days to investigate your complaint
or question. If we decide to do this, we will credit your account
within ten business days for the amount you think is in error, so that
you will have the use of the money during the time it takes us to
complete our investigation. If we ask you to put your complaint or
question in writing and we do not receive it within ten business days,
we may not credit your account. If we decide that there was no error,
we will send you a written explanation within three business days after
we finish our investigation. You may ask for copies of the documents
that we used in our investigation.
You agree to properly
maintain any accounts you have with Harvest Community Bank and to comply
with the Terms and Conditions governing these accounts.
RESPONSIBILITIES
OF HARVEST COMMUNITY BANK
If we do not complete a
transfer to or from your account (or cancel a transfer) on time or in
the correct amount according to our agreement with you, we will be
liable for your losses or damages.
There are some
exceptions to Harvest Community Bank’s liability for processing
transactions on the consumer’s accounts. We will not be liable, for
instance:
1. If, through no fault of
ours, you do not have enough money in your account to make the transfer;
2. If the transfer would go
over the limit on your overdraft protection;
3. If the funds in your account
were attached or the transfer cannot be made because of legal
restrictions affecting your account;
4. If the systems were not
working properly and you knew about the breakdown when performing the
transaction;
5. If circumstances beyond our
control such as interruption of telephone service or telecommunication
facilities, or natural disaster (such as a fire or flood) prevent the
transfer, despite reasonable precautions that we have taken;
6. If you have not properly
followed the instructions for using Harvest Community Bank’s Internet
Banking Services;
7. If your operating system or
software was not properly installed or functioning properly.
WARRANTIES
Harvest Community Bank
is not liable for any damages or injury you may suffer or incur arising
out of or relating to the site or the Internet Services, including,
without limitation, damages or injury caused by: any performance or
failure to perform; error; omission; interruption; deletion; defect;
transmission delay; operational delay; service interruptions;
communications failure; theft; destruction; unauthorized access to, use
or alteration of your information; computer viruses or other software
related problems; or inaccuracies, errors or unreliable information on
the site, whether resulting wholly or in part from Harvest Community
Bank’s breach of contract, negligent acts or omissions, other tortuous
conduct or for any other reason. Without limiting the generality of the
foregoing, Harvest Community Bank shall not be liable for any
consequential, indirect, special, incidental or punitive damages, that
may arise out of or relate to your use or access of, or your inability
to use or access, the site for the Internet Services, or the
transactions processed or attempted to be processed through the site,
even if Harvest Community Bank has been advised of the possibility of
such damages. If you live in a state that prohibits limitations or
exclusions of liability or of certain damages, the foregoing limitation
may not apply to you.
Neither Harvest
Community Bank, software suppliers nor any information providers make
any warranty, express or implied, to you concerning the software,
equipment, browser, the site or the Internet Services, all of which are
provided “as, where is”. Harvest Community Bank hereby disclaims any
and all warranties, including without limitation, implied warranties of
merchantability, fitness for a particular purpose and noninfringement of
third party rights. Your use of the site and Internet Services is at
your own risk.
Harvest Community Bank
desires and intends for the information contained in the site to be
accurate, correct and reliable, but, without limiting the generality of
the foregoing warranty disclaimer, Harvest Community Bank does not
warrant, and it specifically disclaims any warranty, that the site will
contain accurate, correct and reliable information, that the Internet
Banking Services will be uninterrupted or error-free or that the site or
its web servers will be free from computer viruses or software-related
problems.
By your use of Internet
Banking Services, you acknowledge that the Internet Banking Services may
not perform as you intend, notwithstanding any efforts of Harvest
Community Bank, software providers, information or Internet service
providers or you.
The foregoing
disclaimers may not apply to you, if you live in a state that prohibits
such disclaimers.
TERMINATION
Your Internet Banking
Services remain in effect until terminated by you or us. You may cancel
your Internet Banking Services at any time by notifying us of your
intent to cancel via email, or calling 1 856 769-5044, ext. 308 or writing to us

This cancellation
applies only to your Internet Banking Services and does not terminate
your other relationships with us. We may terminate your participation
in the Internet Banking Services for any reason, at any time. We will
try to notify you in advance, but we are not obliged to do so.
CHANGES IN TERMS
AND OTHER AMENDMENTS
Harvest Community Bank
reserves the right to amend, add or remove portions of the Terms and
Conditions of Use at any time. If any such amendment results in greater
cost or liability to your or stricter limitations on the frequency or
dollar amounts of transfers, we will give you at least 30 days notice by
mailing a copy of the amendment to you at your most recent address shown
on our records or, if you have previously agreed, by providing a notice
delivered to the last email address you have provided us. Otherwise,
Harvest Community Bank will not provide you with advance notice of any
amendments to the Terms and Conditions of Use. Harvest Community Bank
recommends that you check these Terms and Conditions of Use from time to
time. You shall be deemed to have accepted any changes we make to the
Terms and Conditions of use if you use the site any time after such
changes have been made.
SITE USE
MONITORING
Harvest Community Bank
reserves the right to monitor your use of the site.
INTELLECTUAL
PROPERTY LICENSE AND RESTRICTIONS
You may use the site
for your personal use. You may not create a link from your website to
the site or redeliver any of the pages, text, graphic images or content
of the site using framing technology, without Harvest Community Bank’s
prior written consent. You may download any software available from the
site for your personal use, but Harvest Community Bank does not transfer
title or ownership of any such software to you and you may not
distribute, sell, assign, transfer, reverse engineer, decompile or
disassemble, any such software. You may not copy, reproduce, republish,
transmit, display, modify, distribute or otherwise transfer Harvest
Community Bank’s logos, or the pages, text, content or graphic images on
the site in any way, except as specifically provided in this section.
ELECTRONIC NOTICE
Through the use of
equipment or software, you can use electronic mail (email) to contact us
about inquiries, maintenance and/or problem resolution issues. Email
may not be a secure method of communication over the Internet.
Therefore, we recommend you do not send confidential information by
email. There may be times when you need to speak with someone
immediately, especially to report a lost or stolen password. In these
cases, do not use email. Instead, call us at

BUSINESS DAYS AND
HOURS OF OPERATION
"Business days" means Monday through Friday, excluding Saturday, Sunday
and federal banking holidays set forth under the laws of the United
States. Customer Support is available 24 x 7 by calling 1-866-873-9578.
GEOGRAPHIC
RESTRICTIONS
The Internet Banking
Services described in this agreement are solely offered to Harvest
Community Bank customers residing in the United States of America.
Citizens and residents may not be able to access the Internet Banking
Services outside the United States and the site may not be appropriate
for use by persons outside of the United States. By using the site, you
represent and warrant that you do not reside in any country other than
the United States. You also represent and warrant that you are not a
national or resident of any country, or territory, other than the United
States. You agree that you will not download any software from the site
for export to any location outside of the United States.
GOVERNING LAW
This Agreement shall be
construed in accordance with and governed by the laws of the State of
New Jersey without regard to choice on conflicts of law principles.
Users of Internet Banking acknowledge that all transactions must comply
with the laws of the United States, including without limitation
economic sanctions administered by the US Treasury Department’s Office
of Foreign Assets Control (OFAC).
If any provision of
these Terms and Conditions of Use are declared or deemed to be unlawful,
unenforceable or void for any reason, then that provision shall be
deemed severable from these Terms and Conditions of Use and will not
affect the validity or enforceability of the remaining provisions.
SCOPE OF
AGREEMENT
The preceding Terms and
Conditions of Use represents the entire agreement between Harvest
Community Bank and you relating to Internet Banking Services, and no
other statement, oral or written, including without limitation, the
materials on the site shall constitute part of this agreement.
